Types of Spousal Support

Spousal support, also known alimony, can be divided into two categories: long-term support or permanent support. A type of long-term support, “reimbursement” is one form. Temporary support may be available to a spouse before finalizing the divorce.

The judge can decide how long an ex-spouse must support the other. It is just as up to the judge to determine the amount of support. Judges may start by assuming that support should last half the time as the marriage. Then they look at various factors and adjust accordingly.

While most states do not have guidelines regarding the length of support, some do. For example, Indiana and Texas limit payments to three years unless there are exceptional circumstances. Utah’s support cannot last longer than the marriage. In some states, the marriage must last at least ten year before a court can order support. The nature of the support will determine how long the support lasts.

A former spouse may receive multiple types of support. If one spouse receives more than one type of support, such as rehabilitative or short-term support, then the rehabilitative support would cease when the spouse becomes employed again. The short-term support would be continued until the end.

Temporary support while the divorce proceedings are pending

To make spousal support arrangements, you and your spouse do not need to wait for everything to be settled in divorce proceedings. The support issue is important right away after you divorce, in order to provide support for the spouse with a lower income while the divorce proceedings are ongoing.

A written agreement regarding temporary support is a good idea. A signed agreement is required to deduct taxes from payments. You’ll likely spend some time in court arguing about a temporary support amount if you don’t reach an agreement. You have a right of support. Support for Rehabilitative and Short-Term Care

Long-Term Support or Permanent

If the judge determines that the spouse who is dependent will not be able to return to work and will require support indefinitely, permanent support can be granted. Some states do not allow permanent support.

Although it may seem odd, even permanent support can end at some point. It ends when the recipient dies. It can also end if the recipient marries again. It can also end in half of the US if the recipient moves in with someone else in a relationship similar to a marriage, where they provide mutual support and share financial responsibilities.

Assistance with reimbursement

Only spousal support that is not entirely based on financial need is reimbursement support. It’s intended to help a spouse who has made sacrifices in education, training or career advancement, and take any job that will support the family, while the other spouse pursues a lucrative career.

Both spouses expected that the spouse who sacrificed would be able to enjoy a higher standard of living once they were married and have a higher income. If the marriage ends before the spouse receives any benefits, reimbursement support helps to rebalance the scales by allowing the professional spouse to return some of what they received during the marriage.

It is not tied to a need and reimbursement support ends when the agreement or court order states it does. The event of the supported spouse becoming a worker or remarrying does not usually trigger its termination.
